The short version
- Daybreak helps you plan and keep daily routines. It isn’t medical advice.
- Checks are made by your phone and can be wrong. Exercise within your limits.
- Alarms depend on your phone. If waking up on time really matters, keep a backup alarm.
- Daybreak Plus is a subscription billed by Apple, with a free trial for new subscribers. You manage or cancel it in your Apple Account.
1. Agreement
These terms are an agreement between you and Ahmed Rashwan (“we”, “us”) for the Daybreak app and the website at getdaybreakapp.com (together, “Daybreak”). By downloading or using Daybreak you agree to them. If you don’t agree, please don’t use Daybreak. Our privacy policy explains how we handle your information.
2. What Daybreak is, and isn’t
Daybreak lets you build morning, evening and custom routines from daily habits, run them one step at a time, check some habits with your phone’s camera or Apple Health, and ring an alarm at your routine time.
- Daybreak is a personal planning tool. It is not a medical device and doesn’t give medical, psychological or fitness advice. If you have a health condition, including ADHD or a sleep disorder, follow the advice of your doctor or other professional.
- Alarms use iPhone’s alarm system (iOS 26 and later). They can’t ring if your phone is off, out of battery or not updated, and settings on your phone can affect them. Don’t rely on Daybreak alone where missing an alarm could cause harm or loss; keep a backup.
3. Who can use it
You must be at least 13 years old to use Daybreak. If you are under the age of majority where you live, you need permission from a parent or guardian, including to subscribe.
4. Your account
An account is optional. If you create one, give us an email address you control, keep your password private and tell us if you think someone else has used your account. You’re responsible for activity on your account.
5. Checks
Habits can be confirmed by a photo check, a short video check, counting reps with the camera, a timer or Apple Health. These checks are made automatically on your phone and are estimates: they can miss a real rep, reject a real photo, or accept a photo or clip that isn’t what it seems. A check marked “verified” is a helpful signal, not a guarantee, and you shouldn’t rely on it for anything important, such as decisions about health, work or money. For most habits you can mark them done without proof; they are then recorded as not verified.
6. Health and safety
Exercise such as push-ups and squats carries a risk of injury, including when you do it to turn off an alarm. Only do exercise you are fit for, stop if you feel pain, dizziness or shortness of breath, and choose another way to turn off the alarm if you can’t exercise safely. Place your phone somewhere stable before counting reps. You use Daybreak’s exercise features at your own risk, to the extent the law allows.
7. Subscriptions
Daybreak is free to download. Using it after onboarding needs Daybreak Plus, a subscription sold through the App Store.
- The price, billing period and free trial are shown in the app and the App Store before you buy. Prices may vary by country and include any applicable taxes.
- New subscribers who are eligible get a 7-day free trial. You won’t be charged if you cancel at least 24 hours before the trial ends. Any unused part of a trial ends when you buy a subscription.
- Payment is charged to your Apple Account when you confirm the purchase, or when the free trial ends.
- Subscriptions renew automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before that end.
- You can manage and cancel your subscription in your Apple Account settings at any time. Cancelling stops future renewals, and you keep access until the end of the period you paid for.
- Refunds are handled by Apple under its policies. Your statutory rights as a consumer are not affected.
8. Using Daybreak fairly
Don’t use Daybreak to break the law, to try to access other people’s accounts or our systems, to interfere with how Daybreak works, or to copy, resell or reverse engineer it except where the law allows.
9. Your content and ours
What you put into Daybreak (your routines, habits, photos and history) is yours. Photos never leave your phone; the rest is synced to your account only if you have one. Daybreak itself, including its design, code, artwork, companions and name, belongs to us or our licensors. We give you a personal, non-transferable licence to use the app on Apple devices you own or control, as allowed by the App Store terms.
10. Apple terms
If you got Daybreak from the App Store, Apple’s Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula) also applies. In addition:
- these terms are between you and us, not Apple, and we, not Apple, are responsible for Daybreak and its content;
- Apple has no obligation to provide maintenance or support for Daybreak;
- if Daybreak fails to meet an applicable warranty, you may tell Apple and Apple will refund the purchase price, if any; to the extent the law allows, Apple has no other warranty obligation for Daybreak;
- we, not Apple, are responsible for handling any claims relating to Daybreak, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims and intellectual property claims;
- you confirm that you are not located in a country subject to a U.S. Government embargo or listed as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
11. Changes and availability
We keep improving Daybreak, so features may change. We may suspend or end Daybreak, ideally with notice. Because your data lives on your phone, it stays there even if the service changes.
12. Disclaimers
Daybreak is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be uninterrupted or error-free, that alarms will always ring, or that checks will be accurate. Nothing in these terms limits rights you have as a consumer that can’t be limited by contract.
13. Liability
To the extent the law allows, we aren’t liable for indirect or consequential losses, or for losses caused by relying on checks, reminders or alarms, and our total liability to you is limited to the amount you paid for Daybreak in the 12 months before the claim, or 50 US dollars if that is more. We don’t exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t let us exclude.
14. Ending
You can stop using Daybreak at any time and delete the app (your synced data stays in your account until you delete the account); remember to cancel Daybreak Plus in your Apple Account if you don’t want it to renew. You can delete your account in the app (You, then Manage account, then Delete account) or by asking us. We may suspend or close an account that breaks these terms.
15. Law
These terms are governed by the laws of England and Wales, and disputes go to the courts of England and Wales. If you live elsewhere, you keep the protection of the mandatory consumer laws of your country and can bring proceedings in your local courts.
16. Changes to these terms
We may update these terms. We’ll change the date above and, for meaningful changes, tell you in the app before they take effect. If you keep using Daybreak after that, the new terms apply.
